Aviation Safety Institute retains the right to vary the training and assessment program to deal with unforeseen circumstances. This includes cancelling or rescheduling a training program and changing trainers if occasion obliges us to do so. These circumstances include such circumstances as the sickness or death of the course presenter, loss of premises etc. Aviation Safety Institute is not responsible for repayment of any ancillary costs associated with the students attendance at the course
Aviation Safety Institute does not own the premises for the course, and as such does not guarantee the safety of the premises. Aviation Safety Institute advises the student and the student notes that Aviation Safety Institute may be renting the premises where the course is to be held and Aviation Safety Institute takes no responsibility for the personal safety of the student or the students property, including any vehicles parked by the student in or about the location of the course.
The student indemnifies Aviation Safety Institute and will hold Aviation Safety Institute harmless for loss of or damage to any of the students property, person injury suffered by the student or any other loss suffered by the student which is not sustained as a direct result of the negligence of Aviation Safety Institute.
Aviation Safety Institute will deliver the training and associated information with due care but does not guarantee the benefit the student will get from the course.
The Intellectual Property in the training and assessment material and the information provided by Aviation Safety Institute will remain the sole and exclusive property of Aviation Safety Institute. The student is not entitled to use the materials for any other use other than to increase the students own knowledge.
The student will participate in the course as directed by the course trainers and presenters. If the student does not participate in the course as instructed by the trainers and presenters or if the student causes disruption to the presentation of the course, the student will be asked to leave the course. If the student then does not leave, other action may be taken including police action to remove the student from the course. In such circumstances, no money paid by the student or their financial sponsor will be refunded to the student or their financial sponsor by Aviation Safety Institute.
The student will be liable for any injury, loss, claim, course of action, verdict, judgements, costs, claim for costs, expenses, demand or damages arising out of or as a consequence of any act or omission of the student while the student is participating in the course.
Individual students must agree with the Aviation Safety Institute Terms and Conditions of Enrolment, to which access will be provided to the student.
This agreement is governed by the laws of New South Wales, Australia, and the student irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of New South Wales, Australia.
This agreement forms the entire agreement between Aviation Safety Institute and the student and supersedes all prior written, oral or other agreements. This agreement or a provision thereof can only be terminated, varied or waived by agreement in writing by both parties or as set out in this agreement.
